By accessing or using the Varkala Jobs website ("Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Platform. These terms are governed by the laws of India, with specific reference to the Information Technology Act, 2000 and the Indian Contract Act, 1872.
2. About the Platform
Varkala Jobs is a free-to-use job board and talent database for the hospitality and travel industry. The Platform allows candidates to submit their personal details and resume for consideration by employers. We operate primarily in Varkala, Kerala, and across India.
3. User Registration
Registration on the Platform is free for all candidates. By submitting your details and resume, you:
- Confirm that you are at least 18 years of age
- Confirm that all information provided is accurate, complete, and up to date
- Consent to the collection and processing of your personal data as described in our Privacy Policy
- Understand that your profile will be reviewed by our team and may be shared with potential employers
4. Acceptable Use
You agree not to:
- Submit false, misleading, or fraudulent information
- Upload documents that contain malware, viruses, or harmful content
- Use automated tools, bots, or scripts to submit multiple applications
- Attempt to gain unauthorised access to the Platform or its administrative systems
- Use the Platform for any unlawful purpose
5. Intellectual Property
All content, design, logos, and software on the Platform are the property of Varkala Jobs and are protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You may not reproduce, distribute, or create derivative works without our prior written consent.
6. No Employment Guarantee
Varkala Jobs is a talent database and job board. We do not guarantee employment or placement. Registering on the Platform does not create an employer-employee relationship between you and Varkala Jobs. We act solely as an intermediary connecting candidates with potential employers in the hospitality and travel sector.
7. Data Handling
Your personal data is handled in accordance with our Privacy Policy and applicable Indian data protection laws, including the Digital Personal Data Protection Act, 2023. By using the Platform, you consent to the collection and processing of your data as described therein.
8. Limitation of Liability
To the maximum extent permitted by law, Varkala Jobs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform. This includes, but is not limited to, loss of employment opportunities, loss of data, or damages resulting from reliance on information provided through the Platform.
9. Modification and Termination
We reserve the right to modify, suspend, or discontinue the Platform at any time without prior notice. We may also remove any candidate profile that violates these terms or contains inaccurate information. We will make reasonable efforts to notify affected users of significant changes.
10. Dispute Resolution
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Thiruvananthapuram, Kerala, India. Before initiating any legal proceedings, both parties agree to attempt to resolve disputes amicably through mutual discussion.
11. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any matters not covered by these terms shall be governed by the applicable provisions of Indian law.
